  • Thank you for your interest in submitting a waiver request for a 1003 Flexibility Waiver.

    Flexibility through waivers is offered to help support LEAs in their design efforts to: 

    • Improve student performance and outcomes,
    • Improve the efficiency of school operations,
    • Promote innovative educational approaches to student learning.
    • Offer the school or group of schools making the request, flexibility in the administration of educational programs.
    • Advance the mission or purpose of the school or group of schools.

    Before you begin the process, please check the list of non-waivable provisions to ensure the flexibility requested is allowed (this can be found on page 7 of the Flexibility Guide for Indiana’s K-12 Schools document). We encourage you to review the suggested next steps in the Flexibility Guide for Indiana's K-12 Schools (page 17) to help you.

  •  Waiver Description

    Complete the information below showing how the requested waiver will improve student achievement in schools affected by the waiver(s) or decrease barriers to educational reform. Submit any other data supporting the need for the waiver. The completed data will:

    A. Specify the waiver sought;

     

    B. Describe the purpose(s) and overall expected results of waiving the                  requirement;

     

    C. For each school year, describe specific, measurable educational goals for each          LEA affected by the proposed waiver and the students served by the LEA who          are affected by the waiver;

     

    D. Outline clear performance benchmarks that will be reported at the end of the waiver period.

    IC 20-30-2-2.7 (Virtual Instructional Day) Limit to 3 virtual student instructional days.  Use this code if you are requesting additional virtual days (asynchronous student instructional days). 

     

    IC 20-30-2-2 (Instructional Time) Waive the minimum instructional time. Use this code if you are requesting a student instructional day that will be less than the minimum instructional time per grade level.

    Example: Late start or early releases. 

     

    IC 20-30-2-3 (School Days) 180-day school requirement. Use this code if you are requesting to reduce the number of school days. 

     

    Example: Professional Development (PD) days.

  • 2(A). IC 20-30-2-2 Instructional Time

    (statutory minimum is 54,000 minutes for Grades 1-6 and 64,800 minutes for Grades 7-12)
  • IC 20-30-2-2 (Instructional Time) Waive the minimum instructional time. Use this code if you are requesting a student instructional day that will be less than the minimum instructional time per grade level. Example: Late start or early dismissal.

  • Enter the number of instructional minutes that you plan to provide for this school year if your waiver is granted. 

    Example: 

    Current Total Instructional minutes without waiver for grades 1-6: 73,800 minutes 

    Waiver request: 10 early dismissals/late start x 120 minutes each = 1200 minutes 

    73,800 minutes - 1200 minutes = 72,600 minutes

    72,600 minutes Proposed minutes if waiver is granted.

    An introductory meeting
    Monthly resources connected to your goals provided by our team 
    An opportunity to reflect on resources received
    At least one collaborative in-person visit to your district
    At least one virtual group meeting with other 1003 waiver participating schools

    Current Total Instructional minutes without waiver for grades 1-6: 59,400 minutes 

    Waiver request: 3 PD days x 360 minutes each = 1080 minutes 

    59,400 minutes - 1080 minutes = 58,320 minutes

    58,320 minutes Proposed minutes if waiver is granted.

  • Board Resolution

  • Board resolutions should include the specific statute(s) or regulations that the school or school corporation is seeking exemption from, and be signed by at least the board's president. Additionally, the board resolution should include specific details of the school or corporation’s plan to leverage the requested flexibility. A general statement in support of the submission of the application will not be sufficient.

    • For school corporations: Please attach a copy of the governing body’s resolution indicating approval to submit this application.
    • For charter schools: Please attach a copy of the governing body’s resolution indicating approval to submit this application and documentation from the charter authorizer indicating support to submit this application.                                                                                                                                        
    • For non-public schools: Please attach documentation from the non-public school’s leadership body or agency indicating approval to submit this application.
